1. Scope of application

1.1 The business relationship between the restaurant MINNECI, owner: Boris Jakir, Zirkelschmiedsgasse 28, D-90402 Nuremberg (hereinafter "Seller") and the customer (hereinafter "Customer") shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.

1.2 You can reach our customer service for questions, complaints and objections Tuesday to Friday from 10:30 a.m. to 11:30 a.m. on the telephone number +49 911 229655 and by e-mail at info@restaurant-minneci.de

1.3 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their independent professional activity (§ 13 BGB).

1.4 Deviating terms and conditions of the customer shall not be recognised unless the seller expressly agrees to their validity.

2. Cancellation conditions for pre-contractual obligationsltnisse

§ 1 Validity of the general cancellation conditions
These terms and conditions of our restaurant "MINNECI" are the basis for table reservations. Subsidiary agreements and amendments to the contract must be made in writing. This also applies to the cancellation of the text form requirement.

§ 2 Binding nature of table reservations
With your table reservation, you make a legally binding declaration that you will appear in the restaurant at the time of the reservation with the announced number of people and that you will select and order from the food and drinks offered on the menu. A contractual obligation is thus established with the table reservation.

§ 3 Cancellation free of charge(1) If you are unable to keep the agreed date and cancel the reservation at least 24 hours before the agreed date, no cancellation fees will be charged. In your own interest and to avoid misunderstandings, we advise you to cancel by e-mail to our e-mail address: info@restaurant-minneci.de, by telephone or in person at the restaurant.
(2) Furthermore, no fees will be charged if it is still possible for us to assign the table you have cancelled to other guests at short notice.

§ 4 Cancellation fees
If you do not cancel your table reservation in good time in accordance with § 3 Para. 1 or if you do not appear at the reserved time on that day, we can demand reasonable compensation for our useless expenses. These cancellation fees amount to 50,00 € per registered guest. The same applies if fewer than the announced number of guests turn up.

§ 5 Proof of lesser damage
You are at liberty to prove that no or significantly lower costs were incurred than the above lump sum.

§ 6 Late arrival at the restaurant
Late arrival at the restaurant of up to 45 minutes after the agreed time is tolerated and does not give rise to a claim for cancellation fees. In the event of late arrival, please contact our restaurant in good time.

§ 7 Assertion of cancellation fees
You will receive an invoice from the MINNECI restaurant for the cancellation fees incurred sent to the address you provided when making the reservation with 14 days payment term.

§ 8 Reimbursement of additional expenses
If you have commissioned us to provide additional services, such as special table decorations, we will always invoice our expenses separately. On request, we will provide you with information and submit the relevant receipts.

§ 9 Cancellation fees for reservations of 10 or more people
For reservations of 10 persons or more, you can cancel the booking free of charge up to 14 days before the desired reservation date.

  • For cancellations up to 7 days before the desired reservation date, we reserve the right to charge a cancellation fee of 50,00 € per registered guest.
  • In the event of cancellation less than 7 days before the desired reservation date, we reserve the right to charge a cancellation fee of 100,00 € per registered guest.
  • If you arrive with less than the announced number of guests, our cancellation fee according to 2 § 4 in the amount of € 50.00 per guest who does not appear will apply.  

§ 10 Proof of lower damages
You are at liberty to prove in accordance with 2 § 5 that no or significantly lower costs have been incurred than the above lump sum.

3. Exclusive bookings

§ 1 Booking
We are available for exclusive bookings for up to 70 people. We can accommodate 35 guests in the dining room and 35 guests in the cellar vault. We recommend that you enquire at least 90 days in advance for an exclusive booking.

§ 2 Minimum turnover
For an exclusive booking of our restaurant, we estimate a minimum turnover as follows, regardless of the number of people you wish to come with:

Monday – Thursday:
3.465,00 € gross for dishes(7 %)
1.715,00 € gross for drinks(19 %)    

Total: 5,180.00 € gross

Friday – Sunday and before public holidays:

4.158,00 € gross for dishes (7 %)
2.058,00 € gross for drinks (19 %)

Total: 6.216,00 € gross

§ 3 Deposit
For the exclusive booking of our restaurant we expect a deposit in the amount of the minimum turnover. The reservation is only confirmed as binding once the deposit has been paid.

§ 4 Opening hours for exclusive bookings
As we also pay attention to the regular working hours of our employees despite exclusive bookings, we would like to point out that events at our restaurant end at midnight. If this time is exceeded, a service fee of 50,00 € per employee present and per hour or part thereof will be charged.

§ 5 Cancellation conditions for exclusive bookings
As described in 3 § 3, the reservation is only confirmed as binding if the full down payment of the minimum turnover, see 3 § 2, has been made. The deposit must be paid at least 45 days before the reservation is made.

  • In the event of cancellation up to 30 days before the event, we will refund 50 % of the agreed minimum turnover.
  • In the event of cancellation up to 14 days before the event, we will refund 25 % of the agreed minimum turnover.
  • Cancellations made less than 14 days before the event will NOT be refunded.
4. Storage of the contract text

4.1 The customer can print out the text of the contract before submitting the order to the seller by using the print function of his browser in the last step of the order.

5. Final provisions

5.1 The place of jurisdiction and place of fulfilment is the registered office of the seller if the customer is a merchant, a legal entity under public law or a special fund under public law.
5.2 The contract language is German.
5.3 Platform of the European Commission for online dispute resolution (OS) for consumers: http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
