1. Scope of application
1.1 The business relationship between the restaurant MINNECI, owner: Boris Jakir, Zirkelschmiedsgasse 28, D-90402 Nuremberg (hereinafter "Seller") and the customer (hereinafter "Customer") shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.
1.2 You can reach our customer service for questions, complaints and objections Tuesday to Friday from 10:30 a.m. to 11:30 a.m. on the telephone number +49 911 229655 and by e-mail at info@restaurant-minneci.de
1.3 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their independent professional activity (§ 13 BGB).
1.4 Deviating terms and conditions of the customer shall not be recognised unless the seller expressly agrees to their validity.
2. Cancellation conditions for pre-contractual obligationsltnisse
§ 1 Failure by the customer to honour a booking
These terms and conditions of our restaurant "MINNECI" are the basis for table reservations. Subsidiary agreements and amendments to the contract must be made in writing. This also applies to the cancellation of the text form requirement.§ 2 Binding nature of table reservations
With your table reservation, you make a legally binding declaration that you will appear in the restaurant at the time of the reservation with the announced number of people and that you will select and order from the food and drinks offered on the menu. A contractual obligation is thus established with the table reservation.
§ 3 Cancellation free of charge
(1) If you are unable to keep the agreed date and cancel the reservation at least 24 hours before the agreed date, no cancellation fees will be charged. In your own interest and to avoid misunderstandings, we advise you to cancel by e-mail to our e-mail address: info@restaurant-minneci.de, by telephone or in person at the restaurant.
(2) Furthermore, no fees will be charged if it is still possible for us to assign the table you have cancelled to other guests at short notice.
§ 4 Loss of revenue
If you do not cancel your table reservation in good time in accordance with § 3 (1) or if you do not appear at the reserved time on that day, we can demand reasonable compensation for our useless expenses. These cancellation fees amount to 75,00 € per registered guest.
§ 5 Proof of lesser damage
You are at liberty to prove that no or significantly lower costs were incurred than the above lump sum.
§ 6 Late arrival at the restaurant
Late arrival at the restaurant of up to 45 minutes after the agreed time is tolerated and does not give rise to a claim for cancellation fees. In the event of late arrival, please contact our restaurant in good time.
§ 7 Assertion of Loss of revenue
You will receive an invoice from the MINNECI restaurant for the cancellation fees incurred sent to the address you provided when making the reservation with 14 days payment term.
§ 8 Reimbursement of additional expenses
If you have commissioned us to provide additional services, such as special table decorations, we will always invoice our expenses separately. On request, we will provide you with information and submit the relevant receipts.
3. Exclusive bookings
3.1 Reservations for 10 or more people are treated as exclusive bookings.
3.2 For exclusive bookings, we will provide you with a binding quote for food and drink upon request. If no such quote has been provided, our minimum spend as set out in § 11 (2) shall apply.4. Cancellation policy for pre-contractual obligations relating to exclusive bookings

§ 11 Minimum turnover for exclusive bookings
We calculate the minimum spend for exclusive bookings per person as follows:
(1) The price of the agreed set menu, as per the quotation received, is per person. In addition, we estimate a drinks turnover of 50% of the agreed set menu price per person. For a set menu price of €120.00 per person, this means an additional €60.00 in drinks turnover per person.
(2) If no specific offer has been made, our minimum four-course meal requirement at the price valid at the time of your booking on our website www.restaurant-minneci.de shall apply. The additional drinks charge of 50% of the menu price remains in force, as explained in § 11 (1).
§ 12 Cancellation for exclusive bookings of 10 or more persons
(1) If you are unable to keep the scheduled appointment and cancel the reservation no later than 60 days prior to the scheduled date, no charge will be made for lost revenue.
(2) In the event of cancellation up to 30 days prior to the event date, we charge for a 50% loss of revenue in accordance with § 11 of the event's agreed minimum turnover.
(3) In the event of cancellations made up to 14 days prior to the event date, we charge for a 75% loss of revenue in accordance with § 11 of the event's agreed minimum turnover.
(4) In the event of cancellations made less than 14 days prior to the event date, we charge 100% of the revenue loss in accordance with § 11 of the event's agreed minimum turnover.
(5) Please note: Should we be able to reallocate the spots, we will refund the full amount per person. However, we reserve the right to charge a flat administrative fee of €10.00 to cover processing costs. You are always free to demonstrate that the actual loss incurred by us is lower than the cancellation fee.
In your own interest and to avoid misunderstandings, we advise you to cancel in writing via email to our email address: info@restaurant-minneci.de.
§ 13 Opening hours for exclusive bookings
As we also pay attention to the regular working hours of our employees despite exclusive bookings, we would like to point out that events at our restaurant end at midnight. If this time is exceeded, a service fee of 50,00 € per employee present and per hour or part thereof will be charged.
5 Storage of the contract text
5.1 The customer can print out the text of the contract before submitting the order to the seller by using the print function of his browser in the last step of the order.6. Final provisions
6.1 The place of jurisdiction and place of fulfilment is the registered office of the seller if the customer is a merchant, a legal entity under public law or a special fund under public law.6.2 The contract language is German.
6.3 Platform of the European Commission for online dispute resolution (OS) for consumers: http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
